Delivery Partner Terms & Conditions
These Terms & Conditions govern the use of the ExpressFoodie platform by delivery partners. By registering, accessing or using the platform for delivery operations, you agree to comply with all operational policies, partner guidelines and applicable legal requirements.
1. Welcome
Welcome to the Express Foodie Delivery Partner Platform.
These Delivery Partner Terms & Conditions ("Terms", "Terms & Conditions") govern the relationship between
EXPRESS FOODIE LLP ("Express Foodie", "we", "our" or "us") and each individual who is approved to provide
delivery services through the Express Foodie Platform ("Delivery Partner", "you" or "your").
These Terms apply to your access to and use of the Express Foodie Delivery Partner Mobile Application, together
with the delivery-related services, features, tools and operational facilities made available by Express Foodie
from time to time.
The Delivery Partner Platform enables approved Delivery Partners to receive and manage delivery assignments,
access relevant order information, complete restaurant pickup and customer delivery activities, update delivery
status, view applicable earnings and operational information, manage availability and attendance where
applicable, and use other delivery-related features provided through the Platform.
By applying to become a Delivery Partner, completing the onboarding or verification process, accessing your
Delivery Partner account, accepting a delivery assignment or using the Delivery Partner Platform, you
acknowledge that you have read, understood and agreed to these Terms and the applicable Express Foodie policies,
agreements and operational requirements.
If you do not agree with these Terms, you must not register as a Delivery Partner or access or use the Express
Foodie Delivery Partner Platform.
2. Company Information
The Express Foodie Delivery Partner Platform is operated by EXPRESS FOODIE LLP, a limited liability partnership
incorporated under the applicable laws of India.
Express Foodie operates a technology-enabled platform through which customers, Restaurant Partners and approved
Delivery Partners can be connected and coordinated for food delivery services.
Express Foodie may provide Delivery Partners with access to technology-based tools, delivery assignments, order
information, location-based operational features, communication facilities, earnings information, training
resources, support services and other related platform functionality.
The registered and official contact details of EXPRESS FOODIE LLP are provided in the Contact Us section of
these Terms and through the official communication channels made available by Express Foodie.
3. Services Covered
These Terms govern the delivery-related services and platform functionality made available to approved Delivery
Partners through Express Foodie, which may include:
• Delivery assignment and order management.
• Restaurant order pickup and customer delivery.
• Delivery status updates and delivery workflow.
• Location-based delivery operations.
• Delivery Partner availability and attendance features.
• Earnings and delivery-related information.
• COD-related operational processes, where applicable.
• Customer and Restaurant Partner communication relating to active deliveries.
• Training, operational guidance and support.
• Other delivery-related platform features introduced by Express Foodie from time to time.
The availability of any particular feature or service may depend on the Delivery Partner's account status,
eligibility, service area, operational requirements, platform functionality and applicable Express Foodie
policies.
Express Foodie may introduce, modify, restrict, suspend or discontinue particular features or operational
processes from time to time in accordance with applicable laws, platform requirements, security considerations
and legitimate business or operational needs.
4. Nature of Services
Express Foodie operates as a technology platform that facilitates and coordinates food delivery operations
between customers, Restaurant Partners and Delivery Partners.
Express Foodie does not prepare or manufacture the food supplied by Restaurant Partners. Responsibility for food
preparation, food quality, food packaging and restaurant-side order fulfilment remains with the applicable
Restaurant Partner, subject to applicable laws and the agreements governing the relevant relationship.
The Delivery Partner is responsible for carrying out assigned delivery activities in accordance with these
Terms, applicable Express Foodie policies, operational procedures and applicable laws.
Delivery Partners are expected to use the Express Foodie Platform responsibly and follow the applicable
procedures for receiving or accepting assignments, collecting orders, updating delivery status, completing
deliveries and communicating with customers and Restaurant Partners in connection with active
deliveries.
Nothing in these Terms is intended to transfer to Express Foodie any responsibility that is legally imposed upon
a Delivery Partner, Restaurant Partner or any other party under applicable law.
The legal nature of the relationship between Express Foodie and a Delivery Partner shall be determined in
accordance with applicable law and any applicable agreement or arrangement between the parties. These Terms do
not, by themselves, create a partnership or agency relationship between Express Foodie and the Delivery Partner,
except to the extent expressly established under applicable law or a separate written agreement.
Nothing in these Terms is intended to waive, exclude or restrict any statutory right, benefit, protection or
obligation that applies to the Delivery Partner or EXPRESS FOODIE LLP under applicable law, including applicable
laws relating to gig and platform workers, social security, safety or other mandatory legal requirements.
5. Changes to These Terms
EXPRESS FOODIE LLP may update, modify or revise these Terms from time to time to reflect changes in:
• Applicable laws or regulatory requirements.
• Platform features or technology.
• Delivery operations and procedures.
• Security and account-protection requirements.
• Business or operational practices.
• Delivery Partner services and platform requirements.
Where appropriate, material changes may be communicated through the Express Foodie Delivery Partner Mobile
Application, in-app notifications, email, official website or other officially recognized communication
channels.
An updated version of these Terms will become effective from the date specified in the updated version.
Continued access to or use of the Express Foodie Delivery Partner Platform after the applicable effective date
may constitute acceptance of the updated Terms, to the extent permitted by applicable law.
If a Delivery Partner does not agree with an updated version of these Terms, the Delivery Partner may
discontinue use of the Platform and follow the applicable account closure or exit procedure.
1. Eligibility to Become a Delivery Partner
Any individual who meets the applicable eligibility requirements and is legally permitted to provide
delivery-related services through the Express Foodie Platform may apply to become a Delivery Partner.
The Delivery Partner must be at least eighteen (18) years of age, or such other minimum age as may be required
by applicable law for the relevant delivery activity.
To apply for onboarding, the applicant must:
• Provide true, accurate and complete information during the application and onboarding process.
• Be legally eligible to perform the delivery activities for which the applicant is applying.
• Have the necessary authority and lawful ability to use the vehicle or other mode of transport intended for
delivery activities, where applicable.
• Hold and maintain any licence, registration, permit, insurance or other legally required authorization
applicable to the delivery activities being performed.
• Provide the information and supporting documents reasonably required by Express Foodie for identity,
eligibility, account, vehicle, safety, regulatory or operational verification.
• Agree to comply with these Terms & Conditions and applicable Express Foodie policies and operational
requirements.
Meeting the above requirements does not automatically guarantee approval as a Delivery Partner. Onboarding and
activation remain subject to completion of the applicable verification and approval process.
2. Eligibility Verification
EXPRESS FOODIE LLP may verify the information and documents provided by an applicant before approving the
Delivery Partner account and may conduct additional verification where required during the relationship.
Verification may include, where applicable:
• Identity and personal information.
• Contact information.
• Driving licence and vehicle-related information.
• Other documents or information required for lawful delivery operations.
• Information necessary for account security, fraud prevention and operational verification.
The applicant is responsible for ensuring that all information and documents submitted to Express Foodie are
genuine, valid, accurate and current.
If any required information or document is missing, expired, inconsistent, unverifiable or otherwise does not
satisfy the applicable requirements, Express Foodie may delay, reject or restrict the onboarding or activation
process until the relevant issue is resolved.
Where verification requirements change because of applicable law, regulatory requirements, safety requirements
or operational needs, Delivery Partners may be required to provide updated information or documents.
3. Right to Review, Suspend or Refuse Onboarding
EXPRESS FOODIE LLP reserves the right to review each Delivery Partner application before approving access to the
Express Foodie Delivery Partner Platform.
Express Foodie may refuse, delay or discontinue an onboarding application where, for example:
• Required information or verification has not been completed.
• Information or documents provided are false, inaccurate, misleading, forged, expired or cannot be
verified.
• The applicant does not meet an applicable legal, safety, regulatory or operational requirement.
• The applicant does not have the required authorization to perform the proposed delivery activities.
• The application presents a reasonable security, fraud, compliance or operational concern.
• Approval or continued access would be inconsistent with applicable law or legitimate platform
requirements.
Express Foodie may also review the eligibility of an existing Delivery Partner from time to time. If an
eligibility requirement is no longer satisfied, Express Foodie may restrict, suspend or take other appropriate
action regarding the Delivery Partner's access to the Platform in accordance with these Terms, applicable
policies and applicable law.
Where appropriate, Express Foodie may communicate relevant onboarding or account decisions through the
officially recognized communication channels.
4. Compliance with Applicable Laws
Delivery Partners must comply with all applicable laws, rules, regulations and lawful requirements relating to
their delivery activities and use of the Express Foodie Platform.
This includes, where applicable, requirements relating to:
• Motor vehicle and road traffic laws.
• Driving licences and vehicle-related requirements.
• Vehicle registration and legally required documentation.
• Applicable safety requirements.
• Lawful use of the Express Foodie Platform.
• Any other legal or regulatory requirement applicable to the Delivery Partner's activities.
A Delivery Partner must not perform delivery activities using a vehicle, licence, document or authorization that
is invalid, expired, suspended, revoked or otherwise unlawful.
Delivery Partners are responsible for maintaining the validity of any licence, registration, authorization or
other requirement applicable to their activities and must promptly inform Express Foodie where a material change
may affect their eligibility to provide delivery services.
Express Foodie may request updated information or supporting documents where required to verify continued
eligibility or compliance.
Nothing in these Terms requires a Delivery Partner to perform any activity that would violate applicable law.
1. Onboarding Process
Every individual seeking to provide delivery services through the Express Foodie Delivery Partner Platform
must complete the onboarding process prescribed by EXPRESS FOODIE LLP.
The onboarding process may require the applicant to provide personal, identity, contact, vehicle, banking and
other information or documents necessary for establishing eligibility, completing verification and enabling
delivery-related services.
Depending on applicable requirements and the nature of the delivery services, the onboarding process may
include:
• Submission of required application information.
• Identity and document verification.
• Verification of vehicle and driving-related information, where applicable.
• Verification of payment or bank account details.
• Submission of required photographs or other verification materials.
• Completion of applicable training or onboarding requirements.
• Acceptance of applicable Express Foodie Terms, agreements and policies.
Completion of an application or submission of documents does not guarantee approval or activation as a
Delivery Partner.
Express Foodie may determine whether an applicant satisfies the applicable onboarding and verification
requirements before activating the Delivery Partner account.
2. KYC & Document Verification
As part of onboarding and verification, Express Foodie may require documents and information reasonably
necessary to verify the identity, eligibility and operational details of a Delivery Partner.
Depending on the applicable requirements, such information or documents may include:
• Aadhaar or another permitted identity document.
• PAN or other applicable tax identification information.
• Valid Driving Licence, where required for the delivery vehicle being used.
• Vehicle Registration Certificate (RC).
• Vehicle details, including applicable registration or identification information.
• Vehicle photograph or other vehicle verification information, where required.
• Bank account and payment information required for processing eligible earnings.
• Photograph, selfie or other identity-verification material.
• Other documents or information required for lawful onboarding, verification, safety or operational
purposes.
Express Foodie may verify submitted documents and information directly or through authorized verification or
service providers, where applicable.
Delivery Partners must provide genuine, valid and lawfully obtained documents and must cooperate with
reasonable verification requirements applicable to their onboarding.
Express Foodie may decline or delay activation where required verification cannot be completed or where
submitted information or documents do not satisfy applicable requirements.
Note: Where Aadhaar or Aadhaar-based verification is used, such verification shall be carried out only through
legally permitted processes and in accordance with applicable Aadhaar laws, regulations and UIDAI
requirements.
3. Accuracy of Information
Delivery Partners are responsible for ensuring that all information and documents submitted during onboarding
or subsequently provided to Express Foodie are accurate, complete, current and authentic.
A Delivery Partner must not:
• Submit false, forged, altered or misleading documents.
• Provide information belonging to another person without lawful authorization.
• Misrepresent identity, vehicle ownership, driving eligibility or banking information.
• Provide expired or invalid documents where valid documents are required.
• Conceal any material change affecting eligibility or verification.
If any information or document provided during onboarding changes, expires or becomes inaccurate, the
Delivery Partner must update the relevant information through the officially provided process within the
applicable period.
Providing false, misleading, forged or unauthorized information may result in rejection of the application,
suspension or restriction of the account, termination of access or other action permitted under applicable law
and Express Foodie policies.
4. Account Approval & Activation
A Delivery Partner account will become active only after the applicable onboarding and verification
requirements have been successfully completed and the account has been approved by EXPRESS FOODIE
LLP.
Express Foodie may approve, decline, delay, restrict or otherwise determine the activation status of an
application based on applicable eligibility, verification, safety, operational, legal or compliance
requirements.
Approval of a Delivery Partner account does not constitute a guarantee of any minimum number of delivery
assignments, earnings, working hours or order volume.
Access to particular delivery services or platform features may also depend on the Delivery Partner's account
status, service area, availability, verification status and applicable operational requirements.
Where additional verification is required after initial approval, continued access to the relevant platform
services may be subject to completion of such verification.
5. Ongoing Verification
Express Foodie may request updated information, documents or verification from a Delivery Partner from time
to time where necessary for maintaining accurate account records, operational safety, fraud prevention, legal
compliance, payment processing or platform security.
Ongoing verification may include, where applicable:
• Updated identity or KYC information.
• Renewal or verification of driving-related documents.
• Updated vehicle or registration information.
• Updated bank or payment information.
• Updated photograph or identity-verification information.
• Other information reasonably required for continued access to applicable services.
Delivery Partners are responsible for providing valid and updated information when required.
Failure to complete an applicable verification requirement may result in temporary restriction of relevant
platform features or account access until the required verification is completed.
Express Foodie may also conduct verification checks where it reasonably identifies inconsistencies, suspected
misuse, security concerns or other circumstances requiring account review.
1. Account Registration
To access and use the Express Foodie Delivery Partner Platform, an individual must complete the registration,
onboarding and verification process prescribed by EXPRESS FOODIE LLP.
During registration or onboarding, the Delivery Partner may be required to provide information and documents
necessary for account creation, identity verification, operational requirements and other legitimate platform
purposes.
The Delivery Partner is responsible for ensuring that all information and documents submitted to Express
Foodie are accurate, complete, current and lawfully provided.
A registration request does not automatically create an approved Delivery Partner account. Account activation
shall be subject to completion of the applicable onboarding and verification requirements and approval by
EXPRESS FOODIE LLP.
2. OTP Authentication
The Express Foodie Delivery Partner Platform may use mobile-number and One-Time Password (OTP) based
authentication for account registration, login, verification and account-security purposes.
The Delivery Partner must use the mobile number registered with the Delivery Partner account and must keep
access to that number under their authorized control.
OTP credentials are intended only for the Delivery Partner's own account and must not be shared with any
unauthorized person.
Express Foodie may require additional verification or authentication where necessary to protect the account,
Platform or its users.
3. Account Security
The Delivery Partner is responsible for maintaining the security of their account and authentication
information.
The Delivery Partner must:
• Keep OTPs and other authentication information confidential.
• Not knowingly permit unauthorized persons to access the account.
• Take reasonable precautions to prevent unauthorized use of the registered mobile number or device.
• Immediately inform Express Foodie through the officially provided support channels if unauthorized
access, suspected account compromise or other significant security concerns are identified.
Express Foodie may take reasonable security measures, including restricting access to an account, requiring
additional verification or ending an active session, where necessary to protect the account, Platform or other
users.
4. Authorized Use of Account
A Delivery Partner account is personal to the approved Delivery Partner and may be used only by the person to
whom the account has been registered and approved.
The Delivery Partner must not:
• Allow another person to operate the Delivery Partner account.
• Share OTPs or authentication credentials with another person.
• Use another Delivery Partner's account.
• Create or operate an account using false, misleading or unauthorized information.
• Attempt to bypass account verification or security controls.
• Transfer, sell, rent, lend or otherwise provide the account to another person.
The Delivery Partner remains responsible for activities carried out through their account, subject to applicable
law and the circumstances of the particular case.
5. One Device Policy
For account security and to prevent unauthorized account sharing, the Express Foodie Delivery Partner
Platform may permit an active Delivery Partner account to remain logged in on one authorized mobile device
at a time.
If the same Delivery Partner account is authenticated on another device, the Platform may terminate or
invalidate the previous active session.
The Delivery Partner must not intentionally use multiple devices simultaneously to operate the same Delivery
Partner account or attempt to bypass the Platform's device or session controls.
Express Foodie may require additional verification before permitting a Delivery Partner to change or
re-authorize a device, particularly where unusual, suspicious or unauthorized account activity is detected.
6. Account Review & Suspension
EXPRESS FOODIE LLP may review a Delivery Partner account where necessary to maintain Platform
security, verify account information, prevent fraud or misuse, investigate suspicious activity or ensure
compliance with these Terms and applicable Express Foodie policies.
Express Foodie may temporarily restrict, suspend or disable account access where, for example:
• Account information or verification documents are found to be false, misleading, invalid or
unauthorized.
• Unauthorized account sharing or access is detected.
• Suspicious, fraudulent or abusive activity is identified.
• The Delivery Partner attempts to bypass account, device or security controls.
• The Delivery Partner violates these Terms or applicable Express Foodie policies.
• Continued access to the account may create a security, operational, legal or compliance risk.
Where appropriate, Express Foodie may request additional information or verification before restoring account
access.
Any suspension or restriction under this section shall not prevent Express Foodie from taking any other action
available under these Terms, applicable agreements, policies or law.
1. General Responsibilities
Delivery Partners are responsible for performing delivery-related activities assigned through the Express Foodie
Delivery Partner Platform in a responsible, professional and lawful manner.
Each Delivery Partner shall:
• Use the Express Foodie Delivery Partner Platform only for authorized delivery-related activities.
• Follow the applicable Express Foodie Terms & Conditions, policies, operational procedures and
instructions.
• Accept, manage and complete delivery assignments in accordance with the applicable platform
workflow.
• Provide accurate information to Express Foodie during onboarding and throughout the period of
platform use.
• Keep required account, vehicle and other operational information accurate and up to date.
• Complete assigned delivery activities with reasonable care and attention.
• Follow applicable pickup, delivery, order-status and verification procedures provided through the
Platform.
• Promptly report any material issue, accident, safety concern, order problem, technical issue or other
circumstance that may affect delivery fulfilment through the appropriate Express Foodie communication
channel.
Delivery Partners remain responsible for their conduct and actions while performing delivery-related activities
through the Express Foodie Platform.
2. Professional Conduct
Delivery Partners are expected to maintain professional, respectful and responsible conduct while interacting
with customers, Restaurant Partners, Express Foodie personnel and other persons encountered during delivery
operations.
Delivery Partners must:
• Treat customers, Restaurant Partners and Express Foodie personnel respectfully.
• Communicate professionally during pickup and delivery activities.
• Follow reasonable operational instructions provided through the Express Foodie Platform.
• Avoid abusive, threatening, discriminatory, harassing or inappropriate behaviour.
• Not intentionally interfere with restaurant operations, customer service or delivery operations.
• Not engage in fraudulent, deceptive or unauthorized activities while using the Platform.
• Maintain appropriate conduct while representing or performing services through the Express Foodie
Platform.
Any serious or repeated misconduct may be reviewed by Express Foodie in accordance with the applicable
Terms, policies and applicable law.
3. Customer Information
During delivery operations, a Delivery Partner may receive limited customer information necessary to complete
an assigned order.
Such information may include, where applicable, customer name, delivery address, contact information,
order-related information or other information required for fulfilment of the assigned delivery.
Delivery Partners shall use customer information only for legitimate purposes connected with the assigned
order or services provided through Express Foodie.
Delivery Partners must not:
• Use customer information for personal or unrelated purposes.
• Sell, share, publish, copy or distribute customer information without authorization.
• Use customer contact information for unauthorized marketing or personal communication.
• Retain or reproduce customer information unnecessarily after completion of the relevant delivery.
• Attempt to access customer information unrelated to an assigned delivery.
• Misuse customer information in any manner that may compromise customer privacy or security.
Delivery Partners must take reasonable care to prevent unauthorized disclosure or access to customer
information and must promptly report any suspected misuse, loss or unauthorized disclosure to Express
Foodie.
Delivery Partners must not retain customer information after completion of the relevant delivery except where
such retention is required by Express Foodie, an authorized operational process or applicable law.
4. Food Safety During Delivery
Delivery Partners are responsible for handling food orders with reasonable care from the time of collection
from the Restaurant Partner until delivery to the customer.
Delivery Partners must:
• Collect the order using the applicable pickup verification process.
• Keep the food order properly secured during transportation.
• Take reasonable precautions to prevent food contamination, damage, leakage or unnecessary exposure.
• Keep the delivery bag and other applicable delivery equipment reasonably clean and suitable for use.
• Follow applicable food-handling and delivery instructions provided by Express Foodie or the Restaurant
Partner.
• Avoid unnecessary opening, handling or interference with food packaging.
Delivery Partners must not open, consume, taste, remove, replace, tamper with or otherwise interfere
with the food or its packaging after receiving the order from the Restaurant Partner, except where an
authorized operational or safety procedure expressly requires such action.
Delivery Partners must not intentionally damage, alter, replace or tamper with any food item, packaging, seal or
order contents.
If an order is damaged, leaking, improperly packed or otherwise appears unsafe or unsuitable for delivery, the
Delivery Partner should promptly report the issue through the appropriate Express Foodie support or
operational channel rather than attempting to conceal or independently resolve the issue in a manner that may
compromise the order.
5. Vehicle Responsibility
Where a Delivery Partner uses a vehicle for delivery activities, the Delivery Partner is responsible for
ensuring
that the vehicle used for delivery is suitable for the intended use and is operated in accordance with
applicable
legal requirements.
The Delivery Partner shall:
• Use a vehicle appropriate for the delivery activity.
• Maintain the vehicle in a reasonably safe and roadworthy condition.
• Maintain required vehicle-related documents and approvals applicable to the vehicle and its use.
• Ensure that the vehicle information provided to Express Foodie remains accurate and up to date.
• Take reasonable precautions to protect the order while transporting it.
• Promptly inform Express Foodie of any material change affecting the vehicle used for delivery
activities.
Where required, Express Foodie may request or verify relevant vehicle information or supporting documents
for onboarding, safety, operational or compliance purposes.
6. Compliance with Traffic Laws
Delivery Partners must comply with all applicable traffic, road-safety and vehicle-operation laws while
performing delivery activities.
Delivery Partners must:
• Follow applicable speed limits and traffic signals.
• Wear required safety equipment, including a helmet where legally required.
• Carry and maintain legally required vehicle and driving documents.
• Operate the vehicle in a safe and responsible manner.
• Not use a mobile device in a manner prohibited by applicable traffic laws while driving.
• Not drive while under the influence of alcohol, drugs or any substance that may impair safe driving.
• Not engage in dangerous, reckless or unauthorized driving practices.
• Follow applicable parking and road-use requirements while making deliveries.
Delivery Partners are responsible for complying with applicable traffic laws and for any personal conduct or
violation attributable to their operation of the vehicle.
Express Foodie may take appropriate account-related or operational action where a Delivery Partner's conduct
creates a material safety, legal or platform risk, subject to applicable law and the applicable Express Foodie
policies.
7. Cooperation with Express Foodie
Delivery Partners agree to cooperate with Express Foodie where information or assistance is reasonably
required for legitimate operational, security, compliance, customer-support or dispute-resolution
purposes.
Such cooperation may include:
• Providing clarification regarding an assigned order or delivery.
• Responding to reasonable operational queries.
• Cooperating with order, delivery or account verification.
• Reporting delivery-related incidents or safety concerns.
• Providing relevant information concerning suspected fraud, misuse or unauthorized activity.
• Cooperating with reasonable investigations relating to customer complaints, order issues, account
security or platform misuse.
• Following applicable training, safety and operational guidance provided by Express Foodie.
Delivery Partners shall provide accurate information and cooperate in good faith with legitimate Express
Foodie requests.
1. Attendance
Every Delivery Partner is required to record attendance through the Express Foodie Delivery Partner Platform
before beginning their scheduled work period.
Attendance must be recorded personally by the Delivery Partner using their authorized account and through the
attendance functionality provided in the Platform.
A Delivery Partner must not record attendance on behalf of another person or allow another person to use their
account for attendance or work-related activities.
Attendance records may be used by Express Foodie for operational management, shift tracking, eligibility for
certain platform features, earnings-related calculations where applicable, and maintaining accurate Delivery
Partner activity records.
Delivery Partners are responsible for ensuring that their attendance is correctly recorded at the beginning of
their work period and that the required shift-end process is completed at the end of the work period.
Failure to properly record attendance or complete the required shift-end process may affect the accuracy of
operational records and, where applicable, may affect earnings or other operational calculations.
2. Online / Offline Availability
After recording attendance, an eligible Delivery Partner may change their availability status to Online through
the Express Foodie Delivery Partner Platform.
A Delivery Partner may be permitted to go Online only when the Delivery Partner is within the service area or
other location conditions configured by Express Foodie.
When Online, the Delivery Partner may become eligible to receive delivery assignments subject to applicable
assignment rules, availability, account status, operational requirements and other platform conditions.
A Delivery Partner may change their status to Offline when they are not actively required to remain available
for delivery assignments, subject to any active delivery or other platform restrictions.
A Delivery Partner must not intentionally remain Online while being unavailable to perform assigned delivery
services.
Where a Delivery Partner has an active delivery or other ongoing operational activity, the Platform may restrict
certain account actions, including changing availability status, logging out or taking a break, until the
relevant
activity has been completed or otherwise resolved through the applicable process.
3. Service Area Availability
Express Foodie may define specific service areas, operational zones or geographic boundaries within which
Delivery Partners may be permitted to record attendance, become Online or receive delivery assignments.
Where location-based availability is enabled, the Delivery Partner must be physically present within the
applicable service area before using the relevant availability or attendance functionality.
The Platform may use location information to verify whether the Delivery Partner is within the applicable
service area and to support delivery operations, assignment, safety and platform integrity.
A Delivery Partner must not attempt to bypass, manipulate or falsify location-based restrictions or use any
method intended to misrepresent their actual location.
Express Foodie may modify service areas, geographic boundaries or availability requirements based on
operational needs, service expansion, platform configuration or other legitimate business requirements.
4. Shift Rules
The standard Delivery Partner shift is 8 hours, unless a different shift duration is specifically communicated
or
configured by Express Foodie.
Where a Delivery Partner selects or is assigned an applicable shift or work period through the Platform, the
Delivery Partner is expected to remain available during that selected or applicable period, subject to
applicable
break periods, delivery obligations and Platform requirements.
Nothing in this Section shall be interpreted as excluding any statutory rights, protections or obligations
applicable to Delivery Partners under applicable law.
A Delivery Partner should begin their work period by completing the required attendance process and becoming
Online when eligible to do so.
Delivery Partners are responsible for completing their assigned work and following applicable operational
procedures throughout their shift.
Attendance, availability and shift records may be maintained electronically through the Express Foodie
Platform and may be used for operational and earnings-related purposes where applicable.
A Delivery Partner must not deliberately misuse attendance or availability functionality, including recording
attendance without actually commencing work or remaining Online while not genuinely available for delivery
operations.
5. Breaks
Express Foodie may provide designated break periods to Delivery Partners during their active shift, subject to
operational requirements and the availability of the applicable break functionality in the Platform.
The standard break structure may include:
• Three Short Breaks: up to 15 minutes each.
• One Meal Break: up to 30 minutes, available after completion of 4 hours of the shift.
• Two Emergency Breaks: available for genuine emergency situations, subject to the applicable platform
process.
Break availability may be restricted while a Delivery Partner has an active order or other ongoing delivery
responsibility.
Delivery Partners must not begin a break while an active delivery requires their attention or in any manner that
may unnecessarily delay an order.
Breaks are intended for legitimate personal, meal or emergency requirements and must not be misused to avoid
delivery assignments or operational responsibilities.
Express Foodie may modify break availability, duration or operational procedures where required by business,
operational or legal requirements.
6. Overtime
After completing the standard 8-hour shift, an eligible Delivery Partner may be permitted to continue working
through the overtime functionality provided by the Express Foodie Platform.
Overtime may be subject to platform availability, operational requirements, Delivery Partner eligibility and any
applicable overtime rules or incentives communicated by Express Foodie.
Any additional earnings or incentives associated with overtime, where offered, shall be governed by the
applicable Express Foodie earnings or incentive terms in effect at the relevant time.
Overtime must be recorded through the applicable Platform functionality. A Delivery Partner must not represent
unrecorded working time as approved overtime.
Express Foodie may introduce, modify, suspend or discontinue overtime features or associated benefits based
on operational requirements, business conditions or applicable policies.
7. Shift Completion
Delivery Partners are required to complete the shift-end process through the Express Foodie Delivery Partner
Platform after completing their daily work period.
The Delivery Partner should ensure that:
• All active delivery responsibilities have been completed or properly resolved.
• The required shift-end or attendance-end process has been completed.
• The Delivery Partner has changed their availability status as required by the Platform.
• No active delivery remains pending under their account before ending the work period.
Failure to complete the required shift-end process may result in inaccurate attendance or operational records
and may affect applicable earnings or other calculations.
Once a Delivery Partner has completed and ended their daily shift, they may become eligible to start a new
work period on the following day in accordance with the applicable shift and attendance process.
1. Order Assignment
Express Foodie may assign eligible customer orders to Delivery Partners through the Express Foodie Delivery
Partner Platform based on operational requirements and the Delivery Partner's eligibility and
availability.
Order assignment may take into account factors such as:
• Delivery Partner availability and active status.
• Attendance or shift status, where applicable.
• Current delivery workload.
• Location and proximity to the relevant Restaurant Partner.
• Applicable COD eligibility or account-related requirements.
• Service area and operational availability.
• Other operational factors used by the Express Foodie Platform.
Orders may be assigned manually by authorized Express Foodie personnel or through automated platform
processes.
Assignment Radius
Where distance-based assignment is enabled, Express Foodie may consider Delivery Partners located within an
operational assignment radius of up to 10 kilometres from the relevant Restaurant Partner or applicable
pickup location, subject to service-area availability, Delivery Partner eligibility, current workload, location
accuracy and other operational conditions. The applicable assignment radius may be adjusted by Express
Foodie where required for operational, safety, service-area or business requirements.
An order assignment does not guarantee that the order will remain assigned to a particular Delivery Partner.
Express Foodie may modify, withdraw or reassign an order where required for operational, customer service,
security or other legitimate platform purposes.
2. Order Acceptance
When an order is assigned, the Delivery Partner must review the relevant order information and respond
through the Express Foodie Delivery Partner Platform in accordance with the applicable operational
process.
Acceptance Time Limit
Where an acceptance timer is enabled for a delivery assignment, the Delivery Partner must accept or respond to
the assignment within the time displayed through the Express Foodie Delivery Partner Platform. Under the
standard assignment process, the acceptance window may be 30 seconds from the time the assignment is
presented to the Delivery Partner.
If the Delivery Partner does not accept the assignment within the applicable acceptance window, the Platform
may automatically withdraw or reassign the order to another eligible Delivery Partner. Failure to accept an
assignment within the applicable time does not by itself guarantee any penalty; however, repeated or intentional
non-responsiveness may be reviewed under the applicable operational policies.
The Delivery Partner is responsible for accepting only those assignments that they are able and authorized to
fulfil.
Once an order has been accepted, the Delivery Partner is expected to proceed with the delivery process without
unnecessary delay and in accordance with the applicable operational requirements.
Failure to respond to or accept an assigned order within the applicable platform process may result in the order
being reassigned to another eligible Delivery Partner.
Repeated failure to appropriately respond to assigned orders may affect the Delivery Partner's account,
availability or eligibility in accordance with applicable Express Foodie policies.
3. Order Reassignment
Express Foodie may reassign an order to another eligible Delivery Partner where required for operational
continuity, customer service, delivery efficiency, security or other legitimate business purposes.
Reassignment may occur, for example, where:
• An assigned Delivery Partner does not accept an order.
• The Delivery Partner becomes unavailable.
• The Delivery Partner is unable to reasonably continue the delivery.
• Operational conditions require another Delivery Partner to handle the order.
• The Platform or authorized Express Foodie personnel determine that reassignment is appropriate.
Order reassignment may be performed automatically through the Platform or manually by authorized Express
Foodie personnel.
Delivery Partners must cooperate with legitimate reassignment or operational instructions communicated
through the Platform.
4. Pickup Process
After accepting an order, the Delivery Partner must proceed to the assigned Restaurant Partner and follow the
pickup procedure provided through the Express Foodie Delivery Partner Platform.
The Delivery Partner is responsible for:
• Reaching the assigned Restaurant Partner within the applicable pickup timeframe. Under the standard
delivery workflow, the expected pickup timeframe is up to 30 minutes from the applicable
order/assignment reference time displayed or recorded by the Platform, subject to Restaurant
Partner preparation time, traffic, road conditions, customer/platform instructions, technical issues, safety
circumstances and other factors outside the Delivery Partner's reasonable control.
• Confirming the relevant order before collection.
• Following the required pickup verification process.
• Collecting the correct order from the Restaurant Partner.
• Checking the order and packaging for reasonably apparent issues before leaving the restaurant.
• Handling the order with reasonable care during transportation.
• Updating the order status accurately through the Platform.
The Delivery Partner must not unnecessarily delay the pickup or leave the assigned restaurant with an order that
has not been properly identified or verified through the applicable pickup process.
Where an order is not ready for collection, the Delivery Partner should follow the applicable Platform workflow
and may report the delay through the available operational process.
5. OTP Verification
Where OTP verification is required, the Delivery Partner must complete the applicable OTP verification process
before recording the relevant delivery stage through the Express Foodie Platform.
For restaurant pickup, the Delivery Partner must complete the required restaurant-side OTP or verification
process before marking the order as Picked Up, where such verification is enabled.
For customer delivery, the Delivery Partner must complete the applicable customer-side verification process
before marking the order as Delivered, where such verification is required.
Delivery Partners must not:
• Enter or submit false OTPs.
• Request or use an OTP unrelated to the relevant order.
• Mark an order as picked up before actual collection.
• Mark an order as delivered before actual delivery.
• Request, obtain, use or submit an OTP except in accordance with the applicable Express Foodie
verification process.
Any misuse of OTP verification or delivery status may be treated as a serious operational or security violation.
6. Delivery Completion
After collecting an order from the Restaurant Partner, the Delivery Partner must transport the order to the
designated customer location in accordance with the delivery information provided through the Platform.
The Delivery Partner must:
• Handle the food and packaging with reasonable care.
• Follow applicable traffic and road-safety requirements.
• Proceed to the customer location without unnecessary delay.
Delivery Time Requirement
Under the standard Express Foodie delivery workflow, the expected total delivery time for an eligible order
is up to 45 minutes, subject to the applicable order timing recorded by the Platform. This operational target
may include the applicable restaurant preparation and pickup period and the subsequent delivery period.
The Delivery Partner is expected to complete the delivery within the applicable operational timeframe without
unnecessary delay, while complying with traffic laws, road-safety requirements, customer instructions,
Restaurant Partner procedures and other applicable operational requirements.
A Delivery Partner shall not be held responsible for delays caused by circumstances outside the Delivery
Partner's reasonable control, including Restaurant Partner preparation delays, customer unavailability or delay,
incorrect or materially incomplete delivery information, traffic or road conditions, safety incidents, technical
or
Platform issues, or other circumstances recognized through the applicable Express Foodie operational
process.
• Follow the applicable customer verification or handover procedure.
• Complete the delivery only after the order has actually been handed over to the customer or otherwise
completed through an authorized delivery procedure.
• Update the delivery status accurately and promptly through the Platform.
The Delivered status must not be updated before the Delivery Partner has reached the applicable delivery
location and completed the required handover or verification process.
Where a delivery cannot be completed, the Delivery Partner must follow the applicable Express Foodie support
or exception-handling process rather than falsely marking the order as delivered.
7. Customer Communication
Delivery Partners may communicate with customers only for legitimate purposes connected with an active
order or delivery.
Such communication may include:
• Confirming the delivery location.
• Coordinating the customer's availability for delivery.
• Clarifying reasonable delivery-related information.
• Communicating an operational issue affecting the delivery.
Delivery Partners must communicate professionally and respectfully with customers.
Delivery Partners must not:
• Use customer contact information for personal or unrelated purposes.
• Engage in unauthorized marketing or solicitation.
• Harass, threaten or abuse a customer.
• Share customer information with unauthorized persons.
• Attempt to establish unrelated personal contact with customers.
• Misuse customer information obtained through the Express Foodie Platform.
Customer information must be handled only to the extent necessary for performing the relevant delivery
services and in accordance with applicable Express Foodie policies and applicable law.
8. Operational Workflow
Delivery Partners acknowledge that delivery operations may be supported by automated systems, location-based
technology, platform notifications and authorized Express Foodie personnel.
The operational workflow may include assignment, acceptance, reassignment, restaurant arrival, pickup
verification, pickup, delivery travel, customer arrival, delivery verification and completion of the
order.
Express Foodie may modify the operational workflow, assignment procedures, verification methods, status
requirements or related Platform functionality from time to time to improve delivery operations, security,
customer experience or platform reliability.
Delivery Partners must follow the workflow and instructions displayed through the Express Foodie Delivery
Partner Platform and any legitimate operational instructions communicated by authorized Express Foodie
personnel.
Delivery Partners must ensure that order statuses recorded through the Platform accurately reflect the actual
stage of the delivery.
1. Cancellation Requests
A Delivery Partner may encounter cancellation requests during the delivery process due to circumstances
relating to the customer, Restaurant Partner, order, delivery operations or other platform-related
reasons.
Delivery Partners must not independently cancel an assigned or accepted order unless the cancellation option is
expressly made available through the Express Foodie Delivery Partner Platform or the cancellation has been
authorized through the applicable Express Foodie process.
Where a cancellation request is received, the Delivery Partner shall follow the cancellation procedure provided
through the Delivery Partner Platform and shall not take any action that may improperly affect the order,
customer, Restaurant Partner or delivery process.
The availability and method of cancellation may depend on the current status of the order and the applicable
operational workflow.
2. Delivery Partner Cancellation Requests
After accepting a delivery assignment, a Delivery Partner is expected to complete the assigned delivery in
accordance with the applicable Express Foodie operational process.
If the Delivery Partner is unable to complete an accepted delivery due to a genuine operational, safety,
technical
or other legitimate circumstance, the Delivery Partner should submit a cancellation or assistance request
through the Delivery Partner Platform or contact the designated Express Foodie support channel, where
applicable.
A Delivery Partner must not abandon an accepted order, intentionally stop responding, mark an order as
completed without actual delivery, or otherwise attempt to bypass the prescribed cancellation process.
Express Foodie may review the circumstances surrounding a cancellation request using available platform
records and operational information.
Any applicable financial adjustment, penalty, earning impact or other commercial consequence shall be
determined in accordance with the applicable Express Foodie Cancellation & Dispute Policy, Delivery
Partner Agreement, Express Foodie Delivery Partner Settlement & Earnings Policy or other applicable
business terms.
3. Customer OTP Cancellation
Where the Express Foodie Platform requires customer OTP verification for cancellation of an accepted order,
the Delivery Partner must follow the OTP-based cancellation process provided through the Platform.
The Delivery Partner must not request, obtain, use or enter a customer OTP for any purpose other than the
authorized cancellation process.
A Delivery Partner must not cancel an order by using a customer's OTP without the customer's knowledge or
authorization.
Where a Delivery Partner believes that an accepted order cannot be completed, the Delivery Partner should use
the applicable cancellation request or support process rather than attempting to bypass the required OTP or
system verification process.
Where a cancellation is processed by Express Foodie through an authorized administrative or operational
process, the applicable treatment of the order and any resulting financial adjustment shall be determined in
accordance with the relevant Express Foodie policies.
4. Failed Delivery
A delivery may be treated as a failed delivery where the Delivery Partner is unable to complete the delivery
despite following the applicable delivery process.
Circumstances may include, where applicable:
• The customer cannot reasonably be reached at the provided delivery location.
• The customer does not respond to required delivery communication.
• The provided delivery information is materially incorrect or insufficient.
• The customer is unavailable to receive the order.
• A safety, security or other legitimate circumstance prevents completion of the delivery.
• The order cannot be completed due to circumstances affecting the Restaurant Partner, Delivery Partner,
customer or Platform.
• Any other circumstance recognized under the applicable Express Foodie operational process.
Before marking a delivery as failed, the Delivery Partner must follow the applicable instructions provided
through the Delivery Partner Platform, including any required customer contact, status update, verification or
support procedure.
A Delivery Partner must not falsely mark an order as failed merely to avoid completing a delivery.
Where an order cannot be delivered, the Delivery Partner must follow the instructions provided by Express
Foodie regarding the order, food item, return or other required operational action.
Any applicable earnings adjustment, penalty, compensation or other financial treatment arising from a failed
delivery shall be governed by the applicable Express Foodie policies and agreements.
5. Exceptional Circumstances
Express Foodie may cancel, reassign, suspend, modify or otherwise process a delivery assignment where
necessary due to circumstances affecting the safe, lawful or proper operation of the Platform.
Such circumstances may include:
• Accidents or serious safety concerns.
• Natural disasters or severe weather conditions.
• Road closures, traffic restrictions or other major transportation disruptions.
• Technical or system failures.
• Security incidents or suspected fraudulent activity.
• Customer, Restaurant Partner or Delivery Partner safety concerns.
• Government restrictions, lawful directions or regulatory requirements.
• Unavailability of required delivery services or infrastructure.
• Force majeure events.
• Other circumstances beyond the reasonable control of Express Foodie.
Where an order is cancelled, reassigned or otherwise affected due to an exceptional circumstance, the Delivery
Partner must follow the instructions communicated through the Delivery Partner Platform or by authorized
Express Foodie personnel.
Express Foodie may use available order records, location information, status updates, communication records
and other relevant operational information to determine the appropriate handling of the affected
delivery.
Any resulting financial treatment, including eligibility for earnings, adjustment, compensation or penalty,
shall
be determined under the applicable Delivery Partner Agreement, Cancellation & Dispute Policy, Express
Foodie Delivery Partner Settlement & Earnings Policy or other applicable Express Foodie policy.
1. Overview
Approved Delivery Partners may receive earnings for eligible delivery services completed through the Express
Foodie Platform.
Earnings may depend on the delivery assignments completed, applicable earning structures, eligible bonuses or
incentives, COD-related benefits, applicable deductions or adjustments and other operational factors
determined by Express Foodie from time to time.
The applicable earning structure, settlement process, deductions, bonuses, incentives and other financial
conditions shall be governed by the Express Foodie Delivery Partner Settlement & Earnings Policy,
together with any applicable communication or commercial terms made available to the Delivery Partner.
Express Foodie does not guarantee any minimum number of orders, minimum earnings or fixed earnings unless
expressly communicated under an applicable written arrangement or policy.
2. COD Handling
Where Cash on Delivery ("COD") orders are assigned to a Delivery Partner, the Delivery Partner may be
required to collect the applicable order amount from the customer at the time of delivery.
Delivery Partners are responsible for:
• Collecting the correct COD amount displayed or communicated through the Platform.
• Handling collected cash carefully and securely.
• Maintaining accurate records of COD amounts collected.
• Following the applicable COD deposit or submission procedure prescribed by Express Foodie.
• Promptly reporting any discrepancy, loss, incorrect collection or other COD-related issue through the
officially provided support channels.
COD eligibility, applicable limits, deposit requirements, COD-related bonuses, account restrictions and other
detailed conditions shall be governed by the applicable Express Foodie Delivery Partner Settlement &
Earnings Policy and operational procedures.
Express Foodie may restrict or suspend access to COD orders where applicable financial, operational, security
or account requirements are not satisfied.
3. Settlement
Eligible Delivery Partner earnings shall be settled in accordance with the applicable settlement cycle and
procedures prescribed by Express Foodie.
Settlement may be affected by factors including:
• Completed and eligible deliveries.
• Applicable bonuses or incentives.
• COD amounts or COD-related adjustments.
• Applicable penalties, deductions or other adjustments.
• Account or operational discrepancies.
• Banking or payment processing requirements.
• Other financial adjustments permitted under applicable policies or agreements.
Express Foodie will process eligible settlements using the payment or banking details provided by the Delivery
Partner through the approved process.
Delivery Partners are responsible for ensuring that their bank and other settlement information is accurate and
up to date.
4. Taxes and Statutory Deductions
Payments or earnings payable to a Delivery Partner may be subject to tax deductions, withholding, statutory
deductions or other legally required adjustments, where applicable.
EXPRESS FOODIE LLP may deduct, withhold and remit amounts where required under applicable law and may provide
relevant records or statements where required.
Delivery Partners are responsible for complying with their own applicable tax obligations in relation to amounts
received through the Platform, except to the extent any obligation is required by law to be fulfilled by
EXPRESS FOODIE LLP.
5. Earnings
Delivery Partners may view applicable earnings information through the Express Foodie Delivery Partner
Platform.
Depending on the features made available, earnings information may include delivery-wise earnings, applicable
bonuses or incentives, COD-related earnings, deductions, adjustments and other relevant financial
information.
The earnings displayed through the Platform may be subject to verification, reconciliation or subsequent
adjustment where an error, discrepancy, cancellation, fraud, duplicate entry or other valid financial adjustment
is identified.
The detailed calculation method, applicable earning components, bonuses, incentives, deductions, penalties and
eligibility conditions shall be governed by the Express Foodie Delivery Partner Settlement & Earnings
Policy.
6. Reports
Express Foodie may provide Delivery Partners with access to financial and operational reports through the
Platform or other officially provided channels.
Depending on available features, such reports may include:
• Delivery-wise earnings.
• Settlement information.
• COD-related records.
• Attendance-related information where applicable.
• Bonuses and incentives.
• Deductions or adjustments.
• Other relevant earning information.
Where available, Delivery Partners may also receive downloadable or otherwise accessible records in formats
such as Excel or PDF.
Reports are provided to support transparency and record-keeping and may be subject to reconciliation or
correction where discrepancies are identified.
7. Financial Responsibility
Delivery Partners are responsible for providing accurate financial and settlement information and for properly
handling any money collected on behalf of Express Foodie or in connection with eligible COD orders.
A Delivery Partner must not:
• Misappropriate or retain COD amounts without authorization.
• Submit false or misleading financial information.
• Attempt to manipulate earnings, COD records, bonuses or settlement records.
• Conceal or intentionally fail to report financial discrepancies.
• Use another person's settlement information without authorization.
Where a financial discrepancy, unpaid COD amount, unauthorized retention, fraudulent activity or other
financial liability is identified, Express Foodie may take appropriate action in accordance with the applicable
Express Foodie Delivery Partner Settlement & Earnings Policy, these Terms, other applicable agreements
and applicable law.
Any recovery, deduction, restriction or other financial action shall be subject to the applicable policy,
contractual terms and applicable law.
1. Customer Ratings
Customers may be provided with an opportunity to rate their delivery experience after completion of an order
through the Express Foodie Platform.
Ratings are intended to provide feedback regarding the delivery experience and help Express Foodie maintain
and improve service quality.
Delivery Partner ratings may be based on feedback submitted by customers through the Platform. Express
Foodie does not guarantee any particular rating or minimum rating to any Delivery Partner.
A Delivery Partner's rating may change over time based on the ratings received from customers for completed
deliveries.
2. Customer Reviews and Feedback
Where the relevant functionality is available, customers may submit written feedback, comments or other
service-related feedback regarding their delivery experience.
Such feedback may be used by Express Foodie for legitimate operational purposes, including service-quality
improvement, customer experience management, complaint review and delivery operations.
Delivery Partners must not request, pressure, threaten, influence or otherwise attempt to manipulate a customer
into providing a particular rating or review.
Express Foodie may review customer feedback where necessary to identify potential service issues, misuse or
violations of applicable Platform requirements.
3. Performance Monitoring
EXPRESS FOODIE LLP may monitor delivery-related performance using information generated through the
Express Foodie Platform and other legitimate operational records.
Performance monitoring may include, where applicable:
• Timeliness of delivery-related activities.
• Timeliness of restaurant pickup.
• Order acceptance and assignment activity.
• Appropriate updating of order status.
• Completion of assigned deliveries.
• Delivery-related cancellations or failed deliveries.
• Customer and Restaurant Partner feedback.
• Compliance with applicable delivery procedures.
• Compliance with Platform safety and operational requirements.
• Other delivery-related performance information generated through the Platform.
Performance information may be used to identify operational issues, provide guidance or training, improve
delivery operations and take appropriate action under these Terms and applicable Express Foodie
policies.
Performance monitoring does not guarantee any particular number of orders, earnings, incentives, bonuses or
future assignments.
4. Fair Use of Ratings and Performance Systems
Delivery Partners must use the ratings, reviews and performance-related features of the Express Foodie
Platform honestly and responsibly.
Delivery Partners must not, directly or indirectly:
• Create or arrange false ratings or reviews.
• Ask customers to provide false or misleading feedback.
• Offer money, benefits or other incentives in exchange for a particular rating or review, unless expressly
permitted by Express Foodie.
• Threaten, harass or pressure a customer or Restaurant Partner regarding ratings or reviews.
• Manipulate Platform activity for the purpose of artificially improving performance records.
• Attempt to bypass or interfere with systems used to record delivery performance.
• Use another person's account or identity to influence ratings or performance records.
Any suspected manipulation, abuse or fraudulent activity may be reviewed by Express Foodie and may result in
appropriate action under these Terms, applicable policies or applicable law.
5. Review of Performance Information
Where a Delivery Partner raises a genuine concern regarding a rating, review or performance-related record,
Express Foodie may review the relevant information and available Platform records.
Such review may consider, where applicable:
• Order records.
• Delivery status records.
• Assignment and acceptance records.
• Pickup and delivery timestamps.
• Customer or Restaurant Partner feedback.
• Platform activity logs.
• Other relevant operational information.
Express Foodie may take appropriate corrective or operational action where an error, system issue, misuse or
other relevant circumstance is identified.
A customer rating or review will not automatically be treated as proof of misconduct, and Express Foodie may
consider relevant available information before taking action where a review is required.
6. Performance-Related Actions
Where performance information indicates repeated operational issues, non-compliance or misuse of the
Platform, Express Foodie may take appropriate action in accordance with these Terms and applicable
policies.
Depending on the circumstances, such action may include:
• Providing operational guidance or training.
• Requesting clarification or additional information.
• Reviewing the Delivery Partner's account or relevant delivery records.
• Temporarily restricting particular Platform features.
• Suspending delivery access.
• Taking other action permitted under these Terms, applicable policies or applicable law.
Any applicable earnings adjustment, penalty, incentive or other financial treatment shall be governed by the
relevant Express Foodie policy or applicable commercial terms and shall not be determined solely by a
customer rating.
1. Personal Safety
Delivery Partners are responsible for taking reasonable precautions to protect their own safety while performing
delivery-related activities through the Express Foodie Platform.
Delivery Partners shall:
• Follow applicable safety instructions and operational guidelines provided by Express Foodie.
• Use appropriate protective equipment required by applicable law or operational requirements.
• Avoid undertaking delivery activities when they are physically or otherwise unfit to do so safely.
• Exercise reasonable caution while travelling to and from restaurants, customer locations and other
delivery-related locations.
• Immediately report any serious accident, injury, safety incident or other emergency affecting the
Delivery Partner during an active delivery, where reasonably possible.
• Follow reasonable safety instructions issued by Express Foodie in connection with an active delivery or
emergency situation.
Express Foodie does not require a Delivery Partner to take an unsafe action merely to meet a delivery target or
operational timeline.
2. Road Safety
Delivery Partners using a motor vehicle, two-wheeler, bicycle or any other vehicle for delivery activities must
comply with applicable traffic laws, road-safety requirements and lawful directions of traffic or other
competent
authorities.
Delivery Partners must:
• Hold and maintain any licence, registration, insurance or other legally required documents applicable to
the vehicle and manner of use.
• Wear a helmet or other legally required protective equipment while operating a two-wheeler or other
applicable vehicle.
• Follow applicable speed limits, traffic signals, road signs and traffic regulations.
• Not drive under the influence of alcohol, drugs or any substance that may impair safe driving.
• Not engage in dangerous, reckless or excessively aggressive driving.
• Not use a mobile phone or interact with the Delivery Partner Application in a manner that creates an
unsafe driving condition.
• Maintain the vehicle in a reasonably safe and roadworthy condition.
• Avoid carrying passengers, goods or loads in a manner that violates applicable law or creates an
unreasonable safety risk.
• Stop at a safe location before performing any activity through the Delivery Partner Application that
cannot safely be performed while travelling.
Delivery Partners acknowledge that delivery timelines do not override applicable traffic laws or reasonable
road-safety requirements.
3. Delivery Bag, Uniform and Company-Provided Items
Where Express Foodie provides or requires the use of a delivery bag, uniform, jacket, identification material or
other delivery-related equipment, the Delivery Partner shall use and maintain such items responsibly and in
accordance with applicable Express Foodie guidelines.
Delivery Partners shall:
• Keep the delivery bag reasonably clean and suitable for carrying food orders.
• Take reasonable care of company-provided or company-authorized delivery equipment.
• Not intentionally damage, misuse, alter, sell, transfer or commercially exploit company-provided items.
• Use prescribed delivery equipment only for legitimate delivery-related purposes.
• Follow applicable uniform or appearance requirements communicated by Express Foodie.
• Promptly report loss, theft, material damage or other serious issues affecting company-provided
equipment.
Where a required item is temporarily unavailable, the Delivery Partner should follow the instructions provided
by Express Foodie regarding its use or replacement.
4. Food and Package Safety
Delivery Partners must handle customer orders with reasonable care from the time of pickup until completion
of delivery.
Delivery Partners shall:
• Collect the order through the applicable pickup verification process.
• Keep the order secure during transportation.
• Avoid unnecessarily opening, tampering with or interfering with food packaging.
• Not consume, remove, replace or intentionally alter any part of a customer's order.
• Take reasonable precautions to prevent food, packaging or other order contents from being damaged.
• Not intentionally damage, contaminate or misuse customer orders.
• Report material damage, spillage, missing items or other significant order-related issues through the
appropriate Express Foodie process.
Delivery Partners must follow applicable instructions relating to food handling and order transportation
communicated through the Platform or training materials.
5. Customer Behaviour
Delivery Partners must interact with customers professionally, respectfully and lawfully.
Delivery Partners must not:
• Threaten, abuse, harass, intimidate or discriminate against a customer.
• Engage in inappropriate, offensive or unwanted conduct.
• Make unnecessary personal contact with a customer outside the legitimate requirements of an active
delivery.
• Request or misuse a customer's personal information for unrelated purposes.
• Attempt to obtain unauthorized payments, benefits or personal information from a customer.
• Use customer information for personal marketing, solicitation or any unrelated purpose.
• Photograph, record or otherwise capture a customer, private premises or personal information except
where reasonably necessary for an authorized Express Foodie process, verification, incident reporting or
other lawful purpose.
• Enter a customer's private premises unless reasonably necessary and appropriately authorized for
completion of the delivery.
Any customer dispute should be handled through the appropriate Express Foodie support or operational process
rather than through threatening, abusive or confrontational conduct.
6. Restaurant Behaviour
Delivery Partners must maintain professional and respectful conduct while visiting or communicating with
Restaurant Partners.
Delivery Partners must:
• Follow reasonable restaurant-side pickup procedures.
• Complete applicable order verification before collecting an order.
• Treat restaurant staff respectfully.
• Avoid unnecessary arguments, threats, harassment or abusive conduct.
• Not interfere with restaurant operations.
• Not remove food, packaging, equipment or other property belonging to a Restaurant Partner without
authorization.
• Report pickup-related problems, delays, missing items or order discrepancies through the appropriate
Express Foodie process.
Delivery Partners must not pressure Restaurant Partners to hand over an order where the applicable pickup
verification or operational requirements have not been completed.
7. Emergency Situations
If an accident, medical emergency, safety incident, serious vehicle problem, natural event or other emergency
occurs during an active delivery, the Delivery Partner should first take reasonable steps to protect life and
personal safety.
Where reasonably possible, the Delivery Partner should:
• Move to a safe location where doing so is safe.
• Seek appropriate emergency assistance.
• Inform Express Foodie through the available support or emergency communication channel.
• Provide accurate information regarding the incident when reasonably required.
• Preserve relevant information or evidence where it is safe and lawful to do so.
• Follow lawful instructions of emergency services or competent authorities.
No Delivery Partner is expected to continue an active delivery where doing so would create a serious and
immediate safety risk.
8. Prohibited Conduct
A Delivery Partner must not engage in any conduct that may compromise the safety, security, integrity or
reputation of Express Foodie, its customers, Restaurant Partners, other Delivery Partners or members of the
public.
Prohibited conduct includes, without limitation:
• Dangerous or reckless driving.
• Driving while under the influence of alcohol or drugs.
• Deliberately violating applicable traffic or safety requirements.
• Theft, attempted theft, misappropriation or unauthorized retention of customer orders, cash or other
property.
• Tampering with food orders or their packaging.
• Falsifying delivery status, pickup status, attendance, location or other operational information.
• Misusing customer, Restaurant Partner or Delivery Partner information.
• Sharing account access or allowing unauthorized persons to perform deliveries through the
Delivery Partner account.
• Using another person's Delivery Partner account or credentials.
• Harassing, threatening, abusing or discriminating against customers, Restaurant Partners, Express
Foodie personnel or other Delivery Partners.
• Unauthorized recording, photography or collection of personal information.
• Attempting to manipulate, bypass or interfere with assignment, delivery, attendance, verification,
payment or security systems.
• Any fraudulent, unlawful or unauthorized activity connected with the Express Foodie Platform.
9. Compliance with Safety Instructions
Delivery Partners agree to follow reasonable safety, security and operational instructions communicated by
Express Foodie through the Delivery Partner Application, training materials, official communications or other
authorized channels.
Express Foodie may introduce or update safety procedures where necessary to address operational experience,
platform risks, applicable legal requirements, public safety considerations or changes in delivery
operations.
Failure to comply with applicable safety requirements may result in appropriate operational action under these
Terms, applicable Delivery Partner policies or other applicable agreements.
10. Safety Does Not Override Applicable Law
Nothing in these Terms requires a Delivery Partner to violate traffic laws, safety requirements, lawful
directions
of authorities or other applicable legal obligations.
Where an operational instruction, delivery target or platform feature conflicts with an applicable legal or
safety
requirement, the Delivery Partner must prioritize lawful and safe conduct and report the relevant issue through
the appropriate Express Foodie channel.
1. Suspension of Delivery Partner Account
EXPRESS FOODIE LLP may temporarily suspend, restrict or limit a Delivery Partner's access to the Express
Foodie Delivery Partner Platform where such action is necessary to protect the safety, security, integrity or
proper functioning of the Platform or to address operational, compliance or account-related concerns.
A Delivery Partner's account may be suspended or restricted in circumstances including, but not limited
to:
• Failure to complete or maintain required verification.
• Submission of false, inaccurate, misleading, forged or unauthorized information or documents.
• Unauthorized use or suspected compromise of the Delivery Partner account.
• Serious or repeated violation of these Terms or applicable Express Foodie policies.
• Fraudulent, deceptive, unlawful or abusive conduct.
• Misuse of customer, Restaurant Partner, Delivery Partner or Express Foodie information.
• Serious or repeated violations of delivery, safety or operational requirements.
• Unresolved financial, COD, asset or other obligations arising under applicable agreements or policies.
• Conduct that may create a material safety, legal, financial, operational or reputational risk for Express
Foodie or other platform users.
Where appropriate, Express Foodie may request clarification, supporting information or corrective action
before restoring access.
Suspension may continue for the period reasonably required to complete the relevant review or resolve the
underlying issue.
2. Immediate Suspension or Restriction
EXPRESS FOODIE LLP may immediately suspend or restrict a Delivery Partner's account where continued
access to the Platform may reasonably create a significant risk to:
• Customer or public safety.
• Restaurant Partner or Delivery Partner safety.
• Food, order or COD security.
• Platform security or system integrity.
• Prevention of fraud or unauthorized activity.
• Compliance with applicable law or lawful directions of competent authorities.
In such circumstances, prior notice may not always be practicable.
Where appropriate, Express Foodie may communicate the reason for the suspension and any required corrective
action through the Delivery Partner Platform or other officially recognized communication channels.
3. Termination by Express Foodie
EXPRESS FOODIE LLP may terminate or permanently deactivate a Delivery Partner's account where the
Delivery Partner:
• Commits a serious or repeated breach of these Terms or applicable Express Foodie policies.
• Provides false, forged, misleading or unauthorized information or documents.
• Engages in fraud, theft, misappropriation, deception or other unlawful conduct.
• Misuses customer, Restaurant Partner, COD, order, platform or company-related information or
property.
• Repeatedly fails to comply with applicable operational or safety requirements.
• Causes or attempts to cause material harm to customers, Restaurant Partners, Delivery Partners or
Express Foodie.
• Fails to satisfy applicable eligibility or verification requirements.
• Has an unresolved obligation under an applicable Delivery Partner Agreement or other binding
arrangement.
• Engages in conduct that creates a material legal, financial, operational, security or reputational risk for
Express Foodie.
Express Foodie may also terminate an account where continued access to the Platform is no longer
commercially or operationally supported, subject to applicable law and any applicable agreement.
Termination does not release the Delivery Partner from obligations that arose before the effective date of
termination.
4. Voluntary Exit by Delivery Partner
A Delivery Partner may request to discontinue their association with Express Foodie by submitting an exit or
account closure request through the officially prescribed process.
Where a Delivery Partner Agreement or other applicable written arrangement requires prior notice before
voluntary exit, the Delivery Partner shall comply with the applicable notice requirement.
Where a seven (7) day notice requirement applies, the Delivery Partner should submit the exit request at
least seven (7) days before the intended final date of service, unless Express Foodie approves an earlier
exit or a different arrangement applies.
During the applicable notice period, the Delivery Partner remains responsible for completing applicable
operational, account, financial, COD, company-property and other obligations arising under these Terms and
any applicable agreement.
Express Foodie may waive or modify the applicable notice requirement in appropriate circumstances.
5. Effect of Voluntary Exit
Submission of a voluntary exit request does not by itself immediately terminate the Delivery Partner's account
or release the Delivery Partner from outstanding obligations.
Before the account is finally closed, the Delivery Partner may be required to:
• Complete or properly close active delivery-related obligations.
• Return Express Foodie property or assets provided to the Delivery Partner, where applicable.
• Clear or reconcile outstanding COD amounts or other amounts payable.
• Complete required account or operational procedures.
• Provide any information reasonably required to complete the account closure process.
Final account closure and any applicable financial settlement shall be subject to verification of outstanding
obligations and the applicable Delivery Partner Agreement and policies.
6. Security Deposit and Company Property
Any security deposit, security fee, equipment amount, delivery bag, uniform, jacket, identification material or
other property provided to or held by the Delivery Partner shall be governed by the applicable Delivery
Partner Agreement, Security Deposit Policy or other applicable written arrangement.
Termination, suspension or voluntary exit does not by itself determine whether any security deposit is
refundable, adjustable, withheld or otherwise treated.
Any adjustment or recovery relating to a security deposit or company property shall be made in accordance
with the applicable agreement, documented obligations and applicable law.
Nothing in this section shall be interpreted as creating an automatic forfeiture of the security deposit solely
because the Delivery Partner's account is terminated or the Delivery Partner exits the Platform.
7. Outstanding Earnings and Amounts
Suspension or termination of a Delivery Partner account does not automatically extinguish any amount that has
become payable by either party.
Where applicable, Express Foodie may review:
• Completed delivery records.
• Earnings records.
• COD amounts.
• Adjustments or applicable charges.
• Outstanding company property or asset obligations.
• Other financial records relevant to the Delivery Partner account.
Any final settlement shall be processed in accordance with the applicable earnings, settlement, COD, security
deposit and other relevant policies or agreements.
Where an amount remains payable by the Delivery Partner, Express Foodie may take lawful steps available
under the applicable agreement and law for recovery.
8. Effect of Termination
Following termination or final deactivation of a Delivery Partner account:
• Access to the Delivery Partner Platform may be disabled.
• The Delivery Partner may no longer accept new delivery assignments.
• Active operational features may be restricted or disabled.
• The Delivery Partner's availability or online status may be disabled.
• Access to certain account features or records may be restricted, subject to applicable law and legitimate
business requirements.
• Express Foodie may take reasonable steps to protect customers, Restaurant Partners, Delivery Partners
and the Platform.
Termination shall not affect rights, obligations or liabilities that accrued before the effective date of
termination.
9. Account Records and Information
Following suspension, termination or voluntary exit, EXPRESS FOODIE LLP may retain account, transaction,
delivery, payment, COD, verification, communication, security and other relevant records for as long as
necessary or permitted for:
• Legal and regulatory compliance.
• Accounting and taxation requirements.
• Fraud prevention and security.
• Dispute resolution.
• Enforcement of contractual rights and obligations.
• Protection of Express Foodie and its users.
• Other legitimate purposes permitted under applicable law.
Personal information shall be handled in accordance with the applicable Express Foodie Delivery Partner
Privacy Policy.
10. Survival of Obligations
Any provisions of these Terms or an applicable agreement that by their nature are intended to continue after
suspension, termination or voluntary exit shall remain effective to the extent permitted by applicable
law.
This may include obligations relating to:
• Outstanding payments and financial reconciliation.
• COD amounts and related obligations.
• Confidentiality and protection of information.
• Intellectual property.
• Company property and assets.
• Indemnification, where applicable.
• Limitation of liability, where applicable.
• Dispute resolution.
• Legal and regulatory compliance.
• Record retention.
• Any other obligation that is intended to survive termination.
Termination of the Delivery Partner account shall not prevent either party from exercising rights or remedies
that arose before termination.
1. General Prohibition
Delivery Partners must use the Express Foodie Delivery Partner Platform only for legitimate delivery-related
purposes and in accordance with these Terms, applicable Express Foodie policies, operational procedures and
applicable laws.
A Delivery Partner must not engage in any activity that may compromise the security, integrity, reliability or
lawful operation of the Express Foodie Platform or cause harm to customers, Restaurant Partners, other
Delivery Partners, Express Foodie or any other person.
2. Fraudulent or Deceptive Activities
Delivery Partners must not directly or indirectly engage in fraudulent, deceptive or dishonest activities in
connection with the Express Foodie Platform or any delivery assignment.
Prohibited conduct includes:
• Providing false, forged, misleading or unauthorized information during onboarding, verification or
while using the Platform.
• Manipulating delivery, attendance, earnings, order or account records.
• Creating or using false information for obtaining orders, incentives, bonuses or other benefits.
• Deliberately providing false information regarding delivery status, pickup status, customer arrival or
order completion.
• Attempting to obtain any financial or operational benefit through deception, manipulation or misuse of
the Platform.
• Concealing or misrepresenting information relating to cash, COD collections, orders or delivery
activities.
3. Fake Deliveries and Order Manipulation
Delivery Partners must not create, accept, manipulate or complete a delivery assignment for any purpose other
than legitimately fulfilling the assigned customer order.
The following activities are prohibited:
• Creating or participating in fake or unauthorized deliveries.
• Accepting orders without a genuine intention to complete the assigned delivery.
• Marking an order as picked up when the order has not actually been collected from the Restaurant
Partner.
• Marking an order as delivered when the order has not actually been delivered to the customer.
• Using another person or account to complete an assigned delivery.
• Manipulating order status, delivery records or system-generated delivery information.
• Attempting to generate artificial orders, deliveries, earnings, bonuses or incentives.
• Colluding with customers, Restaurant Partners, other Delivery Partners or any other person to
manipulate the Platform or obtain an unauthorized benefit.
4. GPS, Location and Platform Manipulation
Delivery Partners must not manipulate, falsify or interfere with location information used by the Express
Foodie Platform.
Prohibited activities include:
• Using fake GPS, mock-location applications or other technologies to falsify the Delivery Partner's
location.
• Manipulating device location information to appear within a service area or at a Restaurant Partner or
customer location when the Delivery Partner is not actually there.
• Circumventing location-based attendance, availability, pickup or delivery verification requirements.
• Interfering with or attempting to bypass location-based operational controls.
• Using any unauthorized software, device configuration or technical method to manipulate location or
delivery records.
Express Foodie may use available technical and operational information to identify suspected location
manipulation or other Platform misuse.
5. Account Sharing and Unauthorized Access
Each Delivery Partner account is intended for use only by the individual to whom the account has been
approved.
Delivery Partners must not:
• Share their account with another person.
• Allow another person to accept or complete deliveries using their account.
• Provide account credentials, OTPs or authentication information to an unauthorized person.
• Use another Delivery Partner's account.
• Attempt to access another person's account without authorization.
• Maintain or operate multiple accounts in violation of Express Foodie requirements.
• Allow unauthorized persons to use the Delivery Partner Mobile Application on their behalf.
Delivery Partners remain responsible for maintaining the security of their account and must promptly report
suspected unauthorized access or account compromise through the officially provided support channels.
6. Theft, Misappropriation and Unauthorized Retention
Delivery Partners must not steal, misappropriate, conceal, retain without authorization or otherwise unlawfully
deal with:
• Customer orders or food items.
• Cash or COD amounts collected from customers.
• Restaurant property.
• Delivery equipment or materials provided by Express Foodie.
• Customer or Restaurant Partner property.
• Any other property belonging to Express Foodie, customers, Restaurant Partners or other persons.
COD amounts collected from customers must be handled and deposited or otherwise accounted for in
accordance with the applicable Express Foodie COD and Cash Handling Policy.
A Delivery Partner must not intentionally retain, misuse or conceal any amount or property that is required to
be returned, deposited, handed over or accounted for under applicable Express Foodie procedures.
7. Platform and Technology Misuse
Delivery Partners must not interfere with the proper functioning or security of the Express Foodie
Platform.
Prohibited activities include:
• Attempting unauthorized access to Express Foodie's systems, servers, databases or accounts.
• Bypassing or attempting to bypass security, authentication or operational controls.
• Reverse engineering, modifying or interfering with the Delivery Partner Application except where
expressly permitted by applicable law.
• Using unauthorized software, bots, scripts, automation tools or other technologies to manipulate
Platform operations.
• Introducing malware, viruses or other harmful code into systems or devices used to access the Platform.
• Exploiting technical vulnerabilities or system errors for personal benefit.
• Attempting to access, collect or disclose information belonging to another user without authorization.
8. Unlawful Activities
Delivery Partners must not use the Express Foodie Platform or perform delivery activities for any unlawful
purpose.
This includes conduct that:
• Violates applicable laws or regulations.
• Involves fraud, theft or deception.
• Creates a serious safety or security risk.
• Involves unauthorized possession, use or transfer of property or funds.
• Involves unlawful use or disclosure of personal information.
• Involves any other activity prohibited by applicable law.
Nothing in these Terms permits a Delivery Partner to perform an activity merely because the Platform
technically allows such activity.
9. Collusion and Manipulation
Delivery Partners must not coordinate or collude with customers, Restaurant Partners, other Delivery Partners,
employees, representatives or any other person to manipulate Express Foodie operations.
This includes attempts to:
• Generate fake or unnecessary orders.
• Manipulate order assignments.
• Manipulate delivery status or location information.
• Obtain unauthorized bonuses, incentives or earnings.
• Avoid legitimate charges, penalties or operational requirements.
• Misuse COD or other payment-related processes.
• Circumvent account, attendance, verification or security controls.
10. Reporting Suspected Misuse
Delivery Partners should promptly report suspected fraud, unauthorized account access, fake deliveries, GPS
manipulation, theft, security incidents or other serious misuse of the Platform through the officially provided
Express Foodie support channels.
Express Foodie may review reported incidents using available Platform records, operational information and
other relevant evidence.
11. Action for Prohibited Activities
Where Express Foodie reasonably identifies or suspects a violation of this Section, it may take appropriate
action in accordance with these Terms, applicable policies and applicable law.
Depending on the nature and seriousness of the matter, such action may include:
• Requesting additional information or verification.
• Restricting specific Platform features.
• Temporarily restricting account access.
• Suspending delivery activities.
• Withholding or reviewing disputed earnings or incentives where permitted under applicable agreements
and law.
• Recovering amounts or property owed to Express Foodie where legally permissible.
• Terminating the Delivery Partner's access to the Platform.
• Reporting suspected unlawful conduct to the appropriate authorities where required or considered
appropriate under applicable law.
• Taking any other lawful action available to Express Foodie.
Nothing in this Section limits any other rights or remedies available to Express Foodie under these Terms,
applicable agreements or applicable law.
1. Intellectual Property
All intellectual property rights relating to the Express Foodie Delivery Partner Platform, including its
software,
application, source code, technology, user interface, designs, layouts, graphics, trademarks, logos, trade
names,
branding, databases, text, documentation, training materials, operational materials and other proprietary
content, are owned by or lawfully licensed to EXPRESS FOODIE LLP, unless otherwise stated.
Nothing in these Terms transfers any ownership or intellectual property rights in the Express Foodie Platform or
its proprietary materials to any Delivery Partner.
Subject to these Terms, Express Foodie grants an approved Delivery Partner a limited, non-exclusive,
non-transferable
and revocable right to access and use the Delivery Partner Platform solely for the purpose of performing
authorized
delivery-related activities through Express Foodie.
Delivery Partners must not, without prior authorization from EXPRESS FOODIE LLP:
• Copy, reproduce, distribute or commercially exploit any part of the Platform or its proprietary materials.
• Modify, adapt or create derivative works from the Platform.
• Reverse engineer, decompile, disassemble or attempt to obtain the source code of the Platform, except
to the extent expressly permitted by applicable law.
• Remove, alter or obscure proprietary notices, trademarks or other intellectual property notices displayed
on the Platform.
• Use Express Foodie trademarks, logos, branding or other intellectual property in a manner that may
create confusion or imply an unauthorized relationship or endorsement.
• Use Express Foodie proprietary materials for any purpose unrelated to authorized activities under the
Platform.
All rights not expressly granted to the Delivery Partner under these Terms remain with EXPRESS FOODIE LLP or
the applicable rights holder.
2. Confidentiality
A Delivery Partner may receive or access confidential or non-public information relating to customers,
Restaurant Partners, Express Foodie, delivery operations, orders, pricing, operational procedures, platform
functionality, security measures or other business information.
The Delivery Partner shall use such information only to the extent reasonably necessary to perform authorized
delivery-related activities and shall not disclose, copy, misuse or share such information with any unauthorized
person.
This obligation does not apply to information that is lawfully public, independently obtained without breach of
an obligation, or required to be disclosed by applicable law or a competent authority.
Confidentiality obligations relating to personal information shall also be governed by the applicable
Express Foodie Delivery Partner Privacy Policy and applicable law.
3. Delivery Partner Content
A Delivery Partner may provide or submit certain content through the Express Foodie Platform, including
profile information, photographs, feedback, support communications or other materials that the Delivery
Partner is permitted to submit through the Platform.
The Delivery Partner remains responsible for ensuring that any content voluntarily submitted by them is
accurate, lawful and does not knowingly infringe the intellectual property, privacy or other rights of any third
party.
Where a Delivery Partner voluntarily submits content through the Platform, the Delivery Partner grants
EXPRESS FOODIE LLP a limited right to store, process, reproduce and use such content only to the
extent reasonably necessary to operate the Platform, provide delivery-related services, maintain records,
provide support, ensure security and comply with applicable law.
Any processing of personal information contained in such content shall be governed by the applicable
Express Foodie Delivery Partner Privacy Policy and applicable law.
This right does not transfer ownership of the Delivery Partner's intellectual property to EXPRESS FOODIE
LLP.
Express Foodie may remove, restrict or refuse to display content submitted through the Platform where such
action is necessary to comply with applicable law, protect platform security, prevent misuse or enforce these
Terms.
4. Limitation of Liability
Express Foodie provides technology and platform services for facilitating and coordinating delivery operations
between customers, Restaurant Partners and Delivery Partners.
Except to the extent liability cannot be excluded or limited under applicable law, EXPRESS FOODIE LLP shall
not be responsible for:
• The acts, omissions or conduct of customers, Restaurant Partners, other Delivery Partners or
independent third parties.
• Food quality, preparation, ingredients or packaging provided by a Restaurant Partner.
• Traffic conditions, road conditions, weather conditions or other circumstances affecting delivery
activities.
• Delays caused by circumstances outside the reasonable control of Express Foodie.
• Temporary interruption, unavailability or malfunction of the Platform caused by technical, network,
telecommunications, infrastructure or third-party service issues.
• Losses arising from inaccurate information provided by the Delivery Partner or another platform
participant.
• Any unauthorized use of the Delivery Partner's account resulting from the Delivery Partner's failure to
maintain account security.
• Indirect, incidental, special or consequential losses arising from the use of the Platform, except where
such limitation is not permitted under applicable law.
Express Foodie does not guarantee that the Platform will always be available, uninterrupted, error-free or free
from technical or security issues.
Nothing in these Terms shall exclude, restrict or limit any liability, right or remedy that cannot lawfully be
excluded, restricted or limited under applicable law.
5. Reservation of Rights
All rights, title and interests in and to the Express Foodie Platform, its technology, software, systems,
trademarks, branding, databases, documentation and other proprietary materials not expressly granted to the
Delivery Partner under these Terms are reserved by EXPRESS FOODIE LLP or the applicable rights holder.
EXPRESS FOODIE LLP may, subject to applicable law:
• Update, improve or modify the Platform.
• Introduce new features or services.
• Modify existing functionality or operational processes.
• Restrict or suspend access to particular features.
• Temporarily suspend Platform services for maintenance, security or operational reasons.
• Discontinue particular features or services where necessary.
No such change shall transfer any intellectual property rights of Express Foodie to the Delivery
Partner.
The Delivery Partner shall not acquire any ownership interest in the Express Foodie Platform, technology,
trademarks, branding, systems or other proprietary materials merely by accessing or using the Platform.
1. Governing Law
These Terms & Conditions and the relationship between EXPRESS FOODIE LLP and the Delivery Partner
shall be governed by and interpreted in accordance with the laws of India.
All matters arising out of or relating to these Terms, the Express Foodie Delivery Partner Platform or the
services provided through the Platform shall be subject to the applicable laws and legal requirements in force
in
India.
Nothing in these Terms shall limit or exclude any right, remedy or protection that cannot lawfully be excluded
under applicable law.
2. Jurisdiction
Subject to applicable law, any dispute, claim or legal proceeding arising out of or relating to these Terms, the
Express Foodie Delivery Partner Platform or the relationship between EXPRESS FOODIE LLP and the
Delivery Partner shall be subject to the jurisdiction of the competent courts at Jaipur, Rajasthan,
India.
The parties acknowledge Jaipur, Rajasthan as the agreed jurisdiction for matters arising under these Terms, to
the extent permitted by applicable law.
Nothing in this section shall prevent either party from approaching any court, authority or forum where such
jurisdiction is mandatorily available under applicable law.
3. Dispute Resolution
If a dispute, concern or disagreement arises between EXPRESS FOODIE LLP and a Delivery Partner in
connection with these Terms, the Platform, delivery operations, earnings, account-related matters or any other
applicable service, the parties should first make reasonable efforts to resolve the matter through the official
support or communication channels provided by Express Foodie.
The Delivery Partner should provide relevant details and supporting information reasonably required to review
the matter.
EXPRESS FOODIE LLP may review the dispute using applicable Platform records, delivery records, account
information, communication records, payment or earnings records and other relevant information available to
it.
Where appropriate, Express Foodie may provide clarification, correct an operational record, process an eligible
adjustment or take other appropriate action in accordance with applicable policies and agreements.
If the dispute cannot be resolved through the applicable internal process, either party may pursue any legal
remedy available under applicable law, subject to the jurisdiction provisions set out in these Terms.
1. Force Majeure Events
EXPRESS FOODIE LLP shall not be responsible for any delay, interruption, suspension, unavailability or
failure of the Express Foodie Delivery Partner Platform or related delivery operations to the extent caused by
circumstances beyond its reasonable control.
Such circumstances may include, without limitation:
• Natural disasters, including floods, earthquakes, storms, severe weather conditions or other natural
events.
• Fire, accidents, explosions or other major unforeseen incidents.
• Epidemics, pandemics or public health emergencies.
• War, terrorism, riots, civil unrest or other public disturbances.
• Government orders, restrictions, regulatory actions or other actions of competent authorities.
• Major internet, telecommunications, electricity, cloud infrastructure or network failures.
• Cybersecurity incidents, malicious attacks or other significant technology disruptions beyond the
reasonable control of Express Foodie.
• Strikes, labour disruptions or transportation disruptions affecting platform or delivery operations.
• Major failures or interruptions affecting third-party service providers necessary for operating the
Express Foodie Platform.
• Any other extraordinary circumstance that could not reasonably have been anticipated or prevented
despite reasonable care.
2. Effect on Delivery Operations
Where a Force Majeure event affects delivery operations, Express Foodie may, to the extent reasonably
necessary:
• Temporarily suspend or restrict delivery assignments or platform features.
• Modify or delay delivery-related operations.
• Temporarily restrict service availability in an affected area.
• Take reasonable operational measures to protect customers, Restaurant Partners, Delivery Partners and
the Platform.
• Modify applicable operational procedures for the duration of the affected circumstances.
Express Foodie will make reasonable efforts to restore affected services and normal delivery operations as soon
as reasonably practicable after the relevant circumstances cease.
3. No Liability for Force Majeure
To the extent permitted by applicable law, Express Foodie shall not be liable for losses, delays, missed
delivery
timelines, temporary inability to receive assignments or other consequences directly resulting from a Force
Majeure event.
Nothing in this section shall exclude or limit any liability or legal obligation that cannot lawfully be
excluded or
limited under applicable law.
4. Delivery Partner Responsibility During Exceptional Circumstances
Delivery Partners are expected to act responsibly and prioritize their own safety, customer safety and
compliance with applicable laws during circumstances affecting normal delivery operations.
Where a Force Majeure event makes continued delivery activity unsafe, unlawful or practically impossible, the
Delivery Partner should promptly follow the applicable instructions or support procedures provided through the
Express Foodie Platform or official communication channels.
1. Entire Agreement
These Delivery Partner Terms & Conditions, together with the applicable Express Foodie Delivery Partner
Privacy Policy, Delivery Partner Agreement, Express Foodie Delivery Partner Settlement & Earnings Policy
and other policies, guidelines or operational requirements expressly applicable to Delivery Partners, constitute
the understanding between EXPRESS FOODIE LLP and the Delivery Partner regarding the use of the
Express Foodie Delivery Partner Platform.
These Terms supersede any previous terms, representations or understandings relating specifically to the
Delivery Partner's use of the Platform, to the extent permitted by applicable law.
Where a separate written Delivery Partner Agreement expressly governs a particular matter, that agreement
shall prevail over these Terms to the extent of any inconsistency. A policy specifically applicable to a
particular
subject matter shall govern that subject matter to the extent of any inconsistency, while these Terms shall
continue to govern all other matters.
2. Severability
If any provision of these Terms is determined by a competent court or authority to be invalid, unlawful or
unenforceable under applicable law, that provision shall be interpreted or modified to the minimum extent
necessary to make it valid and enforceable, where legally permissible.
If such provision cannot be made valid or enforceable, it shall be severed to the extent required, without
affecting the validity or enforceability of the remaining provisions of these Terms.
The remaining provisions shall continue to remain in full force and effect to the maximum extent permitted by
applicable law.
3. Amendments
EXPRESS FOODIE LLP may update, modify or revise these Terms from time to time to reflect changes in
applicable laws, regulatory requirements, Platform features, delivery operations, security requirements,
business practices or other legitimate operational requirements.
Where appropriate, material changes may be communicated through the Express Foodie Delivery Partner
Mobile Application, notifications, email, official website or other officially recognized communication
channels.
The updated Terms shall become effective from the date specified in the revised version.
Continued access to or use of the Express Foodie Delivery Partner Platform after the revised Terms become
effective may constitute acceptance of the updated Terms, to the extent permitted by applicable law.
If a Delivery Partner does not agree with the revised Terms, the Delivery Partner may discontinue use of the
Platform and follow the applicable account closure or exit procedure.
